1. Overview

These Terms of Service (“Terms”) govern your access to and use of The Emotional Support Line (“ESL,” “we,” “our,” or “us”), a non-clinical emotional support service operated by Sioux Ink LLC, a Colorado limited liability company doing business as The Emotional Support Line.

By purchasing a session, calling the support line, or accessing any ESL services, you agree to these Terms.
If you do not agree, do not use the service.


2. Nature of Service

The Emotional Support Line provides non-clinical, non-medical, non-therapeutic emotional support.
Our services may include:

  • Emotional validation
  • Nervous system co-regulation
  • Listening
  • Reflective conversation
  • Insight, perspective, and resource-sharing
  • Basic crisis calming techniques (non-medical, non-clinical)

✔ We are NOT:

  • Licensed therapists
  • Medical or mental health professionals
  • Social workers
  • Crisis responders
  • A suicide hotline
  • A substitute for professional medical care
  • A provider of diagnosis, treatment, or clinical intervention

This service is for supportive conversation only.


3. Crisis and Emergency Limitations

ESL does not provide crisis intervention or emergency services.
If you are experiencing or may be experiencing:

  • Suicidal thoughts
  • Homicidal thoughts
  • Medical emergency
  • Domestic violence in progress
  • Threats from others
  • Immediate physical danger

You must call 988, 911, or your local emergency number.

ESL is not responsible for any harm resulting from failure to seek emergency assistance.


4. Age Requirement

You must be 18 years or older to use this service.

Minors are not permitted to call or participate.


5. Payment, Billing & Refunds

You agree to pay all fees associated with your sessions or subscription.

Refunds:

  • No refunds are issued after any portion of a call or session has been used.
  • Refunds may be issued only for unused session credits, upon written request within 30 days.
  • Subscription fees are non-refundable, but may be cancelled at any time.
  • Chargebacks or disputes filed through your bank without first contacting ESL may result in account termination.

6. Call Policies

Call Duration:

  • Calls may be capped at the length purchased.
  • Additional time requires purchasing additional credit.
  • If you exceed your session time, you authorize ESL to charge the card on file for the extended time.

Call Boundaries:

ESL reserves the right to terminate any call immediately at our discretion, including for:

  • abusive or harassing behavior
  • sexual content or innuendo
  • threats
  • intoxication
  • hate speech
  • manipulation or coercive behavior
  • repeated boundary violations

No refunds are provided for calls terminated for violation of these boundaries.


7. No Recording Allowed

ESL does not record calls and does not store audio, transcripts, or case notes.

Callers may not:

  • record audio
  • record video
  • take screenshots
  • store transcripts
  • share call content publicly

Recording or distributing call content is grounds for immediate termination of service without refund.


8. Confidentiality

ESL respects your privacy and keeps conversations confidential except when required by law or when necessary to prevent:

  • imminent harm to self
  • imminent harm to others
  • threats of violence
  • child abuse or neglect
  • vulnerable adult abuse
  • court orders

These exceptions are required by law and do not create a therapist-client relationship.


9. Not Therapy; No Duty of Care

You acknowledge that:

  • ESL is not therapy
  • ESL is not medical care
  • No diagnosis, assessment, or treatment is provided
  • No therapist-client or fiduciary relationship exists
  • ESL has no duty to monitor, follow up, or provide ongoing support

Your use of the service is voluntary.


10. Service Availability

We reserve the right to:

  • modify call hours
  • refuse service
  • block numbers
  • limit or suspend accounts
  • discontinue or change offerings

We make no guarantees of uninterrupted availability.


11. User Responsibilities

You agree to:

  • use the service respectfully
  • provide accurate information
  • seek emergency help when needed
  • refrain from illegal or harmful behavior
  • maintain a safe, private environment during calls

12. Limitation of Liability

To the fullest extent permitted by law:

  • ESL is not liable for any damages arising from use of the service
  • You agree to hold ESL harmless from claims related to your participation
  • ESL provides the service “as-is” without warranties

This includes emotional, psychological, financial, and relational consequences of decisions you make.


13. Governing Law

These Terms are governed by the laws of the State of Colorado.

Any disputes will be resolved exclusively in the state or federal courts located in Denver, Colorado.


14. Modification of Terms

ESL may update these Terms at any time.
The current version will always be posted on the website.

Continued use of the service constitutes acceptance of updated Terms.
